This Privacy Policy (the “Policy”) tells you how Teardusk Limited d.b.a Bounce Cinema ("we", “us”, “our” , Teardusk or “Bounce”) collects and processes your personal information in the context of your use of our website (available at https://www.bouncecinema.com/) (the “Website”), and when you are a participant or partner in any Bounce programmes (“Programmes”) or other initiatives, or otherwise in our course of dealings with you. 

This Policy explains how we will process any personal information that we collect about you, including information that you give to us. It also tells you our practices about your personal information and how we will treat it.

WHAT INFORMATION DO WE COLLECT

Personal information we collect from you

The personal information we collect from you will depend upon our relationship with you and how you interact with Bounce. This personal information may include:

  • your contact details including name, address, phone number, email address and any business contact details;

  • payment information, such as your debit and credit card details when you make a donation to Bounce;

  • communication information that you or a third party submits to us, for example via the general enquiry email address provided on the Website that you can use to contact Bounce.

In addition to the above, as part of our Programmes or other Bounce initiatives we may also collect:  

  • verification details such as your date of birth and a copy of any photo identification (e.g. driving licence);

  • employment or work experience related information, such as your job title and employer name, and information related to your previous work experience;

  • education-related information, such as qualifications.

We may also collect information on your race or ethnic origin as part of any Programme we run aimed at increasing representation of the black community in the film industry or with a similar objective.  This personal information is ‘sensitive’ personal data and we collect this to promote equal opportunities and treatment, as further described below. 

Personal information we collect about you automatically 

If you interact with the Website, as is the case with most websites, we automatically get some technical details such as your chosen browser and unique IP address. As is common to all major websites, we also collect information about your visit, including the date, time and duration of your visit, as well as information about how you are using the Website including the movement of your mouse and what buttons you click. 

How we use your information

How we use your personal information will depend upon our relationship with you and how you interact with us.  In general, we use your personal information for the following purposes:

Ensuring functioning of the Website: including to administer the Website and to improve the Website to ensure that content is presented in the most effective manner for you and for your computer and as part of our efforts to keep the Website safe and secure.

Facilitation of our Programmes and other Bounce initiatives: including to process your application, and assessing your suitability for, to any of our Programmes, as required to facilitate your participation or partner involvement in our Programmes, including introducing participants to partners and to tell you about changes to our Programmes, where you submit any films or any other materials through the Website.

To communicate with you: including to respond to any query you have asked us and where you have asked us do so, to communicate with you regarding news and events and to update you on our events, Programmes and initiatives we think you might be interested in.

For business and administrative purposes: including to process any donations made to Bounce; to facilitate our internal business administration, including maintaining proper business records; to administer databases (including our contacts database); and to comply with our legal obligations and enforce our legal rights.

Where using your personal information is in our legitimate interests

We are allowed to use your personal data where it is in our legitimate interests to do so, and those interests aren't outweighed by any potential prejudice to you. We believe that our use of your personal information is within a number of our legitimate interests, including but not limited to:

  • fulfilling our objective of increasing the representation of black people within the film industry;

  • processing donations to the Bounce cause;

  • providing our donors and other interested third parties with information and marketing materials about our organisation and other information and programmes that we may make available;

  • satisfying our legal obligations;

  • ensuring that the Website runs smoothly.

To promote equal opportunities and treatment 

Where you apply or are involved in any of our Programmes aimed at increasing representation of the black community in the film industry or any Programme with a similar objective, we use your personal information relating to race and ethnic origin in the interests of maintaining and promoting equal opportunities and treatment.  We consider that there is a substantial public interest in doing so. 

Where using your personal data is necessary for us to carry out our obligations under our contract with you

We use your personal data when it is necessary to do so for the performance of our contract with you. For example, we require certain personal information about you in order to facilitate your participation in our programmes.

Where the processing is necessary for us to carry out our legal obligations

Where we have legal obligations that we need to comply with, we use your personal data when we need to in order to comply with those legal obligations.

Where you give us your consent to use your personal information

We use your data where you have specifically consented. You have the right to withdraw any such consent at any time. We have set out details regarding how you can go about this below.

WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We may share your personal data with the following categories of recipients:

  • our affiliated entities;

  • our partner organisations involved in our programmes;

  • participants in our programmes; and 

  • selected third-party service providers who perform functions on our behalf (including third party IT providers, media agencies, payment service providers and professional advisers);

  • tax, audit, or other authorities; Bounce board members, trustees, and advisers and their trusted third party service providers and affiliates;

  • any third party where required to comply with any legal obligation, or to enforce or apply our legal rights; and

  • if we sell or buy any business or assets, we may transfer your personal information to the potential seller or buyer of such business or assets.

HOW WE PROTECT YOUR PERSONAL DATA

All information you provide to us is stored on secure servers.  We also have in place confidentiality provisions (including data protection obligations) in any agreements we have with partners involved in our programmes.

Unfortunately, there is always a risk involved in sending information via the internet. Although we will do our best to protect your personal data, we cannot guarantee the security of your data sent to the Website and so if you send information you do so at your own risk. Once we hold your information, we will use strict procedures and security features to try to stop unauthorised access to it.

WHERE WE TRANSFER YOUR PERSONAL INFORMATION

The information that we collect from you may be sent to, and stored at, a destination outside the European Economic Area, including by any third party providers. Where you have asked us to, we may email you to provide you with Bounce news and events and to update you on our events, Programmes and initiatives we think you might be interested in.  Where we do so, we provide a means to unsubscribe in our such email communications.
